Terms and Conditions of Holiday Tenancy
The terms and conditions of the holiday letting as agreed by both parties are as follows and departure from same by you permits the owner or agent to refuse the key, amend the rent, or immediately terminate the occupancy. If a complaint is received the property will be visited and a written warning of breach of conditions will be given; a second visit will result in eviction.
1. The person making the booking must stay in the property and will be held responsible for the conduct of all guests. The premises are let to you for holiday purposes only for the period stated on the final receipt and for the maximum persons per bed of premises booked. Exceeding maximum numbers will render the guest liable to cancellation of the booking and/or immediate eviction from the property.
2. The premises are available from 2.00 pm on the day of arrival and are to be vacated no later than 9.30 am on the day of departure. The premises are to be left in a clean and tidy condition. (Please ensure dishes, pots and pans etc. are washed and put back into cupboards.) Failure to do so will incur a charge for extra cleaning which will be deducted from your security deposit. If BBQ is provided, a cleaning fee will apply if not left clean.
Deposit of half the tariff plus $55 booking fee to be paid within twenty four (24) hours of booking. For bookings less than $1000 full payment is required. Non-payment of this deposit will be deemed a cancellation of the booking. The balance of rent must be paid thirty (30) days prior to arrival. Cheques will not be accepted for rent prior to fourteen (14) days of arrival. (Christmas & Easter - see below).
CANCELLATIONS: Cancellation within one (1) month of arrival will incur the full forfeit of monies paid, unless the property is re-let. A cancellation fee of $120.00 applies. Booking fee and credit card charges are not refunded. ALL CHANGES AND CANCELLATIONS MUST BE IN WRITING. When booking you acknowledge that Byron Bay First National Real Estate reserves the rite to cancel a booking at any time - if a booking is cancelled by Byron Bay First National Real Estate no cancellation fee will be charged. The booking is made in good faith by our office and may be subject to change. While we cannot accept responsibility for actions taken by the owner of the premises outside our control, we will endeavour to assist you. Tariffs are reassessed annually.
5. Pets are not permitted on or inside the premises unless otherwise stated in writing. If they are permitted on the property no responsibility will be taken by Byron Bay First National Real Estate or the landlord for the welfare/safety of the animal.
6. All damages, breakages or losses to the property, furniture and furnishings are to be reported to the agent and paid for by the guest immediately. Should you discover a default or breakage when you arrive please advise or we will consider those the responsibility of the current guest and charge accordingly. If there are signs of tampering with the owners private cupboards on departure it will be treated as break and enter and will be dealt with accordingly.
7. LOST KEYS - A $55 fee will be charged if agent is called out after 5.00 pm due to misplaced or lost keys. Because of security reasons we are unable to provide a call out service for keys after 9.00pm. If keys are lost, all locks must be changed and the cost will be charged to the security deposit.
8. No responsibility is taken for guest’s personal property left on the premises. Landlord’s insurance does not cover loss of guest’s belongings.
9. Strata Title Law must be observed. Please note you are in a residential area and regard must be paid to the quiet enjoyment of other occupants in the building and in neighbouring properties.
10. In the event the property is offered for sale, the guest agrees to allow the owner or his agent to inspect the property with prospective purchasers during reasonable hours by appointment. The agent cannot be held responsible should a property be sold and the booking cancelled. All endeavours to find alternative accommodation will be made by the agent.
11. No provision can or will be made for relocation if accommodation is deemed unsatisfactory on arrival other than on the basis that the full rental due be forfeited and full rental on new premises is paid prior to occupancy. Guests must accept premises “as booked” and cannot be relocated. We are careful not to misrepresent any rental property. NO REFUND IS GIVEN IF YOU ARE NOT SATISFIED WITH YOUR ACCOMMODATION.
12. The agent endeavours to have any repairs to appliances attended to as soon as possible after reporting of same. However, due to unforeseen circumstances (eg having to order parts or non-availability of tradespeople) the immediate repair may be beyond our control. No responsibility is accepted by the agent for these unforeseen circumstances. There will be no refunds or discounts deducted from tariffs for unusable appliances awaiting repair.
13. SECURITY DEPOSITS: Funds will be deducted from the security deposit if we need to make a claim which may include, but is not limited to, the following: excess cleaning fees, damage or breakages, excess garbage removal, late check out, telephone calls (if applicable), noise complaints. Where the total amount claimed for damages exceeds $150, an agent’s fee of $50 applies.
14. Please check at our office daily should you be expecting a message. There is a charge per sheet for fax messages received. Any message to be delivered will attract a fee of $7.50.
15. No private functions are to be held at rental properties without written consent of owner.
16. This office will not be held responsible for any noise from construction work occurring close to holiday properties.
17. SECURITY CALL OUT: If a security guard is called to the property for any reason including noise complaints, a $100 call out fee will be charged to the security deposit of the guest, a second security call out will incur eviction from the premises.
EASTER AND CHRISTMAS BOOKINGS
1. The balance of all monies must be forwarded to the agent two (2) months prior to arrival. Failure to do so will be considered a cancellation of the booking. No reminders will be issued.
2. Should a cancellation be made prior to two (2) months of arrival an administration fee of $120.00 applies; cancellation within two (2) months of arrival will result in full forfeit of monies paid unless the property is re-let, then a $120.00 administration fee applies.
3. Bookings made within two (2) months of arrival require full payment on booking.
